1. Acceptance of Terms

By accessing or using StreetVision ("the Service"), operated by StreetVision Ltd ("StreetVision", "we", "us", or "our"), a company registered in England and Wales (Company Number: 16770302), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

StreetVision is a software platform that provides tools for cycling infrastructure assessment and ATE Route Checks, including:

• Interactive route drawing and mapping tools
• Automated data collection and analysis
• Assessment scoring and reporting features
• Project collaboration and management tools

3. Account Registration and Access

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

3.3 Pilot Access

Access to pilot features may be subject to additional terms, NDAs, and approval processes.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorised access to any part of the Service
• Upload, transmit, or distribute malicious code or harmful content
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to compete with us or develop competing products
• Share account credentials with unauthorised parties

5. User Content and Data

5.1 Your Content

You retain ownership of all data, content, and materials you upload or create using the Service ("User Content"). You grant us a limited licence to use your User Content solely to provide the Service to you.

5.2 Content Responsibility

You are solely responsible for your User Content and warrant that you have all necessary rights to use and grant us licence to such content.

5.3 Data Processing

Our processing of personal data is governed by our Privacy Policy. For enterprise customers, separate Data Processing Agreements may apply.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works based on the Service without our express written permission.

7. Payment Terms

7.1 Fees

Use of certain features may require payment of fees as described in your subscription plan or pilot agreement.

7.2 Billing

Fees are charged in advance and are non-refundable except as expressly stated in your agreement with us.

7.3 Suspension

We may suspend your access to the Service if payment is overdue, subject to applicable notice periods.

8. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. Please review our Privacy Policy to understand our practices.

9. Service Availability

We strive to maintain high availability but do not guarantee that the Service will be uninterrupted or error-free. We may suspend the Service for maintenance, updates, or other operational reasons.

During the pilot phase, the Service may experience more frequent updates and potential downtime.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will meet your requirements or that any data analysis or assessments will be accurate or comply with specific standards or regulations.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

Either party may terminate your account at any time with appropriate notice. We may terminate immediately for breach of these Terms.

Upon termination, your right to use the Service ceases, and we may delete your User Content in accordance with our data retention policies.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We may modify these Terms at any time by posting updated terms on this page. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
